1. Who we are and how to contact us

1.1 Your contract is with the company named in your offer:

  • CHE London Limited (company number 17272594) for classroom courses; or
  • CHE Online Limited (company number 17272580) for online courses.

1.2 Both companies are registered in England and Wales, with their registered office at 4th Floor, 100 Fenchurch Street, London EC3M 5JD. Both are part of the group led by CHE Health & Wellbeing Limited (company number 10722903) and trade as the Centre for Homeopathic Education. In this Agreement “CHE”, “we” and “us” mean the company named in your offer. This Agreement applies to students who enrol on or after its effective date. If you enrolled before then, the terms you signed continue to apply until you finish your course.

1.3 You can contact us by email at [email protected] or by phone on 020 3405 4580.

1.4 If this Agreement says either of us may contact the other in writing, this means by letter or by email.

2. What this Agreement does

2.1 Your contract with us is made up of your online application form (“Application Form”), your email confirming your place (“Confirmation Email”) and this Agreement. If they differ, they apply in this order: Confirmation Email, this Agreement, Application Form.

2.2 “Programme” means the training, seminars, webinars, online programmes, coaching sessions and other courses described in your Confirmation Email.

2.3 Please read this Agreement carefully before you confirm your place or make any payment. It explains how we provide your Programme, our payment terms and delivery times, when either of us can change or cancel the contract, what to do if there is a fault with your Programme and how we use your personal information.

2.4 Separate terms apply to your use of our websites. These are our Terms and Conditions. If they conflict with this Agreement, this Agreement applies.

2.5 This Agreement must be read with the following, which apply to you as a student: Admissions Policy, Attendance Policy, Assessment and Academic Appeals Policy, Assessment Deferral Policy, Complaints Policy, Equal Opportunities Policy, Safeguarding Policy, Privacy and Cookie Policy and, if you take part in clinical training, the Trainee Clinic Standards. Your Code of Conduct is in Schedule 1. If you hold a bursary or scholarship, the Bursary Terms or Scholarship Terms also apply.

3. Your personal information

3.1 CHE Health & Wellbeing Limited is the controller of your personal information (ICO registration ZB035578). Our Privacy and Cookie Policy explains how we collect and use it. Data protection questions go to [email protected].

3.2 We send you marketing only as set out in the Privacy and Cookie Policy, and you can opt out at any time.

4. Booking and when the contract starts

4.1 You choose your Programme and submit the Application Form. If your application is successful and an interview applies under our Admissions Policy, we invite you to one. If we offer you a place, you receive a Confirmation Email with your Fees and payment options. Your place is booked when we receive payment as set out in that email.

4.2 The contract between you and us starts only when:

  • we confirm that we can provide the Programme to you, usually by email after your Application Form and any interview;
  • you accept your place by agreeing to this Agreement at enrolment; and
  • you make the payment needed to reserve your place, as set out in your Confirmation Email.

4.3 If we tell you that we cannot provide the Programme, we will not charge you. If we have already received payment, we will promptly refund it.

5. Fees, payment and refunds

Fees

5.1 The price of your Programme is the price in your Confirmation Email at the time we confirm your place (“Fees”).

5.2 Any delivery costs are the amounts in your Confirmation Email. Additional costs, such as books and supervision, which are not covered by those Fees, are set out in the Trainee Handbook.

5.3 After you pass each year of the Programme, we will write to you at the end of the academic year with the Fees for the following academic year and the payment options available.

Payment

5.4 When you must pay, and the payment options available, depend on your Programme and are set out in your Confirmation Email.

5.5 You pay through our online checkout by credit or debit card.

5.6 Paying in instalments means CHE is helping you to spread the full cost of the Fees over the period in your Confirmation Email. If you cancel your monthly payments at any time, you must pay the full outstanding Fees within 7 working days, plus interest and an administration fee of £100, as set out in clause 5.12 and section 8.

5.7 Changes to your payment details must be made in writing to the email address we have given you, no later than 5 days before your scheduled payment date. We are not responsible for any charges or penalties that third parties charge you because of a missed payment.

5.8 All payments due under this Agreement must be made in full without deduction or withholding, except as required by law. Neither of us can assert any credit, set-off or counterclaim against the other to justify withholding payment.

5.9 If this contract ends, you must pay any Fees due and outstanding.

5.10 Time is of the essence for payment of all Fees.

5.11 We make all reasonable efforts to avoid errors in our prices. Before we accept your booking, we usually check the website price against our price list in force at the time. If the price on the price list is lower than the website price, we will charge you the lower amount. If the price on the price list is higher than the website price, we will contact you to confirm how you would like to proceed.

5.12 Without limiting any other right or remedy we have for statutory interest, if you do not pay us on time, we may:

  • suspend your access to the Programme, including attendance at workshops, seminars and online training; and
  • charge you interest at 10% a year above the Bank of England base rate from time to time, plus an administration fee of £100.

5.13 Interest builds up each day from the date the amount was due until you pay it, whether before or after any court judgment. You must pay the interest when you pay the overdue amount. If you write to us, we will send you a statement of the interest you owe to date and the amount being added each day.

Refunds

5.14 If you withdraw from the course at least 14 days before the start date of each academic year and you have paid the Fees in full, you can have a refund of the Fees paid, minus the non-refundable Deposit set out in your Confirmation Email.

5.15 If you withdraw less than 14 days before the release of the first module or college weekend and the second module or college weekend (as applicable), you will be refunded two thirds of the Fees, minus the non-refundable Deposit.

5.16 If you withdraw between the release of the first module or college weekend and the second module or college weekend (as applicable), you are not entitled to any refund of the Fees paid and due to be paid. This also applies to the monthly payment option, so you must still make all the remaining monthly payments.

5.17 Students who have been suspended or excluded from CHE for disciplinary reasons, or for not maintaining minimum standards or academic progression, as set out and determined by CHE at its discretion, are not eligible for any refund of the Fees.

5.18 Before we consider any refund or transfer, you must email your request with any supporting documents to [email protected] and complete the withdrawal or interruption procedures in the Trainee Handbook, and we must have recorded you as withdrawn.

5.19 Refunds are made only to the bank account or credit card from which the Fees were originally paid. Please allow 6 weeks from your request to receiving your refund. We do not make refunds in cash under any circumstances.

5.20 All refunds are calculated in UK Sterling. CHE will not refund shortfalls caused by exchange rate changes, or compensate for bank or other charges. Where payment of the Fees was split between more than one payee, any refund is made in proportion to the original split.

6. Dates, times and locations

6.1 We fix the dates, times and locations of each Programme and tell you about them on our website and student portal. It is your responsibility to register, and no alternative or replacement dates, times or locations are available.

6.2 If an event outside our reasonable control occurs, we will notify you by email. Such events include the unavailability of key personnel or key materials, online Programmes being down, epidemic, pandemic, quarantine, breakdown of communication facilities, failure of a web host or internet service provider, natural catastrophes, governmental acts, changes in law, strikes, fire, flood, power failure, civil unrest, acts of terrorism or war. We are not liable to you for failure or delay caused by such an event. If the delay continues for 180 days and we have not provided another way to perform our obligations, either of us may cancel the Programme, and we will refund the part of your Fees for the part of the Programme not delivered.

7. What you can expect from us

7.1 We will deliver the Programme as advertised. In exceptional circumstances lectures may be changed at short notice. In unforeseen circumstances or for factors outside our control, such as the availability of tutors, internet provider or venue, we may alter the dates, content, tutors or format of the course, while making every effort to keep the intended material and style as far as possible. No refunds will be given under any such circumstances.

7.2 The Programme can be demanding. We will support you as appropriate, without compromising your development as an independent learner. We strongly recommend that you seek supervision from a qualified homeopath for additional support.

7.3 Completing the practitioner Programme requires at least 350 Clinical Training hours and at least 22 Supervision hours, recorded separately as set out in the Clinic Handbook.

7.4 We will add to reading materials and reading lists through the student portal or by email, as appropriate. Individual lecturers may advise extra reading.

7.5 Before you pay for your place, we will tell you when we will deliver the Programme. For ongoing services, we will provide them until they are completed or until the contract is cancelled or the services are withdrawn in line with this Agreement. Resources on the student portal are available until the end of each academic year, and until 1 September after you complete your last academic year.

7.6 We will contact you if we are delayed in starting your Programme because of circumstances outside our control. If we do so within a reasonable time, we are not responsible for the delay. If the delay continues beyond a reasonable time, which will not be less than 45 days, you can contact us to cancel the contract, and we will refund any Programme you have paid for but not yet received.

8. What we expect from you

8.1 Once you are legally bound by this contract, you agree:

  • to honour your financial obligations to CHE;
  • that if payments are not made on time, or organised by the start of each academic year so that each payment is received on time, you will pay statutory interest at 10% plus the Bank of England base rate from the date payment is due, plus an administration fee of £100;
  • that it is your responsibility to complete payments as indicated;
  • that you have all the information you need to decide to take part in this training;
  • that the information on your Application Form is accurate; and
  • that if future government legislation on educational institutions affects the cost or delivery of your Programme, CHE may increase student fees accordingly.

8.2 As a student, you must:

  • follow the Student Code of Conduct in Schedule 1;
  • for online Programmes, watch and complete each monthly module of lectures and any assessments given through the year;
  • meet the Attendance Policy, which requires at least 85% attendance;
  • follow the Assessment and Academic Appeals Policy and the Complaints Policy;
  • read widely from the course reading list, attend lectures and clinics as your Programme requires, and produce the required assessments to the standards set by CHE, as set out in the Trainee Handbook;
  • attend all classes and clinics punctually;
  • treat all Programme material as confidential and not distribute or photocopy it without permission;
  • not record or download lectures, by audio or visual devices, without permission;
  • support the Programme by giving feedback when we ask for it; and
  • understand that to progress to the next academic year, you must complete and pass all assessments to the standards set by CHE, and your Fees must be up to date.

8.3 We may restrict or deny your online access, or ask you not to attend classes or clinics, if we consider, at our discretion, that:

  • your behaviour on the course is inappropriate, including any breach of Schedule 1;
  • your attendance is sporadic, or you are repeatedly late or leave early for scheduled tutorials, classes or clinics, online or face to face;
  • you share your login and password details for our digital platform with anyone;
  • you fail to keep to the terms of this contract; or
  • you fail to pay Fees as set out in your Confirmation Email.

8.4 Classes and tutorials are recorded, the recordings are made available to students, and they may be reused as course content. You may keep your camera off, use a first name and ask questions in private chat. You may also object, and we will edit out your contributions before reuse. Details are in the Privacy and Cookie Policy.

9. Pausing, deferrals and suspension

Pausing your course (Programme deferral)

9.1 You can pause your studies at any point in the course for one calendar year only. Fees will be charged for one academic year, with a deferral administration cost of £250. If you pay on a subscription basis, or are on our fast-track online course, the current year’s Fees must be paid in full, even if your studies are paused for one calendar year.

Deferring an assessment

9.2 You can ask to defer an assessment under the Assessment Deferral Policy, which also sets out the £75 penalty fee for missed assessments.

Suspension or exclusion of students

9.3 We may suspend or exclude you from the Programme, at our discretion, for disciplinary reasons or for not maintaining minimum standards or academic progression, as set out in Schedule 1 or the Trainee Handbook, or if you do not keep to your obligations in section 8.

Suspension of the Programme

9.4 If we must suspend the supply of the Programme to you, for example to make minor technical adjustments or resolve technical issues, to implement a change in law or regulatory requirement, or because of unexpected circumstances, we will contact you to let you know.

9.5 We will usually tell you in advance, unless it is an emergency, in which case we will tell you as soon as reasonably possible. If we temporarily suspend supply, your payment will be adjusted so that you do not pay for the suspended item during the suspension.

9.6 If we are going to suspend a Programme for more than 45 days, you may contact us to cancel the contract. We will give you a pro-rata refund for the Programme you have paid for but not yet received.

10. If there is a fault with the Programme

10.1 We hope you are satisfied with your Programme. If you have a complaint, please follow our Complaints Policy.

10.2 We must provide a Programme that meets your consumer rights. This section is a summary of your key rights. For more detail, contact Citizens Advice at www.citizensadvice.org.uk, Citizens Advice Scotland at www.citizensadvice.org.uk/Scotland, call 03454 04 05 06, or contact your local Trading Standards Department.

10.3 If we have provided you with services, the Consumer Rights Act 2015 says:

  • you can ask us to repeat or fix a service if it is not carried out with reasonable care and skill, or get some money back if we cannot fix it;
  • if you have not agreed a price beforehand, what you are asked to pay must be reasonable; and
  • if you have not agreed a time beforehand, the services must be carried out within a reasonable time.

10.4 If we have provided you with digital content, the Consumer Rights Act 2015 says it must be as described, fit for purpose and of satisfactory quality, and:

  • if your digital content is faulty, you are entitled to a repair or replacement;
  • if the fault cannot be fixed, or has not been fixed within a reasonable time and without significant inconvenience, you can get some or all of your money back; and
  • if you can show that the fault has damaged your device and we have not used reasonable care and skill, you may be entitled to a repair or compensation.

10.5 These rights are in addition to any cancellation rights you have during the cooling-off period.
