1.1 CHE PRO is provided by CHE Health & Wellbeing Limited, a company registered in England and Wales under company number 10722903, whose registered office is at 4th Floor, 100 Fenchurch Street, London EC3M 5JD (“CHE“, “we“, “us” and “our“). CHE Health & Wellbeing Limited is part of the Centre for Homeopathic Education group of companies.
1.2 You can contact us at [email protected]. Formal legal notices to us must be sent by email to that address and by post to our registered office.
1.3 “You” and “Member” mean the individual named on the Membership.
2.1 In these Terms the following words have these meanings:
“Annual Plan” means a Membership paid for in a single payment at the start of each Membership Term;
“Cancellation Period” means the 14 days starting on the date we take payment for a new Membership or for a renewal;
“Casework Workshop” means a Live Session in which Members present and discuss clinical cases;
“Community” means the CHE PRO community spaces, currently hosted on Circle and Thinkific Communities;
“Content” means all materials made available through CHE PRO, including the Library, Live Sessions, recordings, text, images and software;
“CPD Certificate” means a certificate of continuing professional development issued to you through the Platform;
“Library” means the on-demand collection of recorded courses, masterclasses and sessions;
“Live Session” means any session broadcast live to Members, including Casework Workshops;
“Member Content” means anything you post, upload, say or share in the Community or during a Live Session;
“Membership” means your CHE PRO membership under these Terms;
“Membership Term” means a 12-month period starting on the date of your first payment or on a Renewal Date;
“Monthly Plan” means a Membership paid for in 12 monthly instalments during each Membership Term;
“Patient Information” means any information relating to an identified or identifiable patient or client;
“Platform” means the websites, apps and systems through which we provide CHE PRO, currently including Thinkific, Kajabi, Circle and Zoom, and any replacement under clause 13; and
“Renewal Date” means the day after a Membership Term ends.
3.1 CHE PRO is a professional membership. To join and to remain a Member you must:
be at least 18 years old; and
be either (i) a qualified homeopath who has completed a recognised homeopathic training, or (ii) a practising homeopath who can show substantial and current professional practice experience that we accept.
3.2You confirm that you are buying the Membership for purposes relating to your profession and not as a consumer. Laws that give additional rights only to consumers therefore do not apply to your Membership, but nothing in these Terms removes any right that cannot lawfully be excluded.
3.3 We verify eligibility after payment. We may ask for evidence such as your qualification certificate, details of your training provider or evidence of your practice experience. You must give us information that is accurate, complete and current.
3.4 If we decide, acting reasonably, that you do not meet the eligibility criteria, we will tell you, close your access and refund your payment in full no later than 28 days after the date of payment. This applies even if a CPD Certificate has been issued to you.
3.5 If you stop meeting the eligibility criteria during your Membership, you must tell us promptly. We may then end your Membership under clause 14.2.
4.1 Each Membership is for one named individual only. You must not share your login details, allow anyone else to use your account, or use CHE PRO on behalf of a clinic, organisation or group. Account sharing is a serious breach of these Terms.
4.2 You are responsible for keeping your login details confidential and for all activity on your account. Tell us immediately if you suspect unauthorised use.
4.3 You need a suitable device, a supported browser and an internet connection to use CHE PRO. You are responsible for these and for any associated costs.
5.1 You may choose the Annual Plan or the Monthly Plan. Both give you a 12-month Membership Term and the same access, including full access to the Library from the start of your Membership. Prices and plan details are shown at checkout.
5.2 Monthly Plan. Each monthly instalment is paid in advance for the month of access that follows it. The first instalment is taken at checkout and later instalments on the same date each month. Once your Cancellation Period has ended you are committed to your Membership for the rest of the Membership Term and cannot cancel mid-term, except under clauses 6.5 and 14.4. Instalments are paid as each falls due and are never brought forward.
5.3Annual Plan. The fee for the whole Membership Term is taken at checkout and on each Renewal Date.
5.4 Price lock. The price you pay when you join is fixed for your Membership, including every renewal, for as long as your Membership continues without a break. If your Membership ends for any reason, any price, discount or offer attached to it ends too, and if you rejoin you will pay the price in force at that time.
5.5 Offers. Offers, including offers to CHE graduates, are subject to any conditions stated when the offer is made and attach only to the Membership for which they are given.
5.6 Switching plans. You may switch from the Monthly Plan to the Annual Plan at any time. The Annual Plan fee is taken on the date you switch, a new 12-month Membership Term starts on that date and no further Monthly Plan instalments fall due. You cannot switch from the Annual Plan to the Monthly Plan until your current Membership Term has ended.
5.7 Payment methods. We accept payment through Kajabi Payments, Thinkific Payments, Stripe and PayPal, using all major debit and credit cards. You authorise us and our payment providers to take recurring payments on the dates set out in these Terms until your Membership ends. Your full card details are held by the payment provider, not by us.
5.8 Currency and taxes. Prices are in pounds sterling (GBP) unless another currency is shown at checkout. Where a payment provider shows or charges the price in a local currency, any exchange rate and any charges made by your bank or card issuer are your responsibility. Prices include any VAT or sales taxes that apply.
5.9 Failed payments. If a payment fails, your access will be suspended and our payment provider may try to take the payment again. We will tell you and ask you to update your payment details. We do not charge late payment fees or interest. Your access will be restored once your account is up to date.
5.10 If a payment is still unpaid 30 days after it was due, we may end your Membership by notice. Instalments that fell due before your Membership ended remain payable, but no further instalments fall due after it ends.
6.1 14-day cancellation right. You may cancel a new Membership, or a renewal, within the Cancellation Period by emailing [email protected] with your name and the email address on your account. You do not need to give a reason. We will remind you of this right in your payment confirmation email and confirm any cancellation by email.
6.2 If you cancel within the Cancellation Period we will refund the payment taken for that Membership or renewal in full, unless a CPD Certificate has been issued to you during that Cancellation Period, in which case no refund is due. Your access ends when we process your cancellation.
6.3 We will make any refund within 14 days of confirming your cancellation, to the payment method you used.
6.4 After the Cancellation Period no refund, in whole or in part, is given for any Membership Term on either plan, except under clauses 3.4, 6.5, 14.3 and 14.4. Your access continues until the end of your Membership Term.
6.5 Service unavailability. If CHE PRO is unavailable to Members for more than 72 consecutive hours, other than because of planned maintenance we have told you about in advance or a problem with your own device or connection, you may end your Membership by emailing us within 30 days after the service is restored. We will refund the fees you have paid for the unexpired part of your Membership Term, and no further Monthly Plan instalments will fall due.
7.1 Your Membership renews automatically on each Renewal Date for a further 12-month Membership Term, on the same plan and at your locked price (clause 5.4), unless it is ended in line with these Terms.
7.2 We will email you a reminder at least one month before each Renewal Date, confirming the Renewal Date, the price and how to stop the renewal.
7.3 To stop your Membership renewing, email [email protected], or use your account settings where available, at any time before the Renewal Date. Your access continues until the end of the current Membership Term.
7.4 The 14-day cancellation right in clause 6.1 applies to each renewal.
8.1 During your Membership you can access:
8.2 New courses, masterclasses and Live Sessions added to CHE PRO during your Membership are included at no extra charge. Specialist events, webinars and courses offered outside CHE PRO are not included, but may be offered to Members at a discounted price.
8.3 We aim to add recordings of Live Sessions to the Library within 2 business days of broadcast. This is a target, not a guarantee. Some sessions or parts of sessions may not be added, for example where a Member has asked for their case to be excluded under clause 11.5.
8.4 We may change the format, delivery schedule, teachers, topics and structure of CHE PRO, and may update, replace or withdraw individual items of Content, provided the overall nature of the Membership is not materially reduced. Teacher names, session titles and schedules are given in good faith and may change.
8.5 Live Sessions are generally scheduled at UK-friendly times. We cannot guarantee that session times will suit every time zone.
9.1 CPD Certificates are issued through the Platform when you complete the relevant video Content.
9.2 Where we state that CHE PRO or any Content is accredited or recognised by a third-party body, we do so in good faith based on the arrangements in place at the time, which may change. It is your responsibility to check that the CPD hours you record meet the requirements of your own professional or registering body.
9.3 Your CPD Certificates remain yours after your Membership ends. You must download them before your access ends, because you will not be able to access the Platform afterwards. We are not obliged to provide copies after your Membership ends, although we may do so at our discretion.
10.1 All Content is owned by CHE or exclusively licensed to CHE by its teachers and other rights holders. All rights not expressly granted to you in these Terms are reserved.
10.2 During your Membership we give you a personal, non-exclusive, non-transferable and revocable licence to view the Content through the Platform for your own professional development. You may apply the knowledge you gain in your own clinical practice.
10.3You must not, and must not help or allow anyone else to:
10.4 CHE PRO does not provide handouts or notes for download.
10.5 A breach of this clause 10 is a serious breach for which we may end your Membership immediately under clause 14.2, in addition to any other rights we have.
11.1 When you present or share a case, you are solely responsible for the Patient Information you share and for complying with data protection law and your professional duty of confidentiality. You act as an independent controller of that Patient Information.
11.2 Before sharing any case you must either:
11.3 You must keep a record of any consent you rely on and provide it to us on request.
11.4 You must keep confidential all cases and Patient Information presented by other Members and must not record, copy or discuss them outside CHE PRO.
11.5 Casework Workshops are recorded and added to the Library. If you do not want your case to be included, tell the moderator before the session starts or email us within 7 days after the session, and we will exclude or edit out your case from the recording.
11.6 If we become aware that Patient Information has been shared in breach of this clause, we may remove it, edit recordings and take action under the Code of Conduct and clause 14.2.
12.1 You must follow the Code of Conduct in Schedule 1 whenever you use the Community or attend a Live Session. The Community is moderated by CHE, and we may review, edit, hide or remove any Member Content at our discretion.
12.2 Live Sessions are recorded. Your name, image, voice, chat messages and questions may appear in recordings that are available to Members in the Library. You can limit this by turning off your camera, changing your display name or choosing not to speak.
12.3 We will only use clips of recordings in which you appear for marketing, or anywhere outside CHE PRO, if you have specifically opted in when we asked you.
12.4 You keep ownership of your Member Content. You grant CHE and its group companies a worldwide, royalty-free, perpetual, irrevocable and non-exclusive licence to host, store, copy, adapt, edit and use your written or shared Member Content to operate CHE PRO and for teaching purposes and FAQs. Where we use it outside the Community we will remove your name unless you agree otherwise. This licence does not cover use of your image or voice in marketing, which is governed by clause 12.3.
12.5 You confirm that your Member Content is your own or that you have permission to share it, and that it does not infringe anyone’s rights or break any law.
12.6 You must not promote your own or anyone else’s practice, products, services, courses, events or communities within CHE PRO, including in the Community, in Live Session chat or in direct messages to other Members.
12.7 Views expressed by teachers, guest speakers and Members are their own and do not necessarily reflect the views of CHE.
13.1 CHE PRO is delivered using third-party platforms. We will use reasonable efforts to keep CHE PRO available but do not guarantee that it will be uninterrupted or error-free. Clause 6.5 sets out your remedy if CHE PRO is unavailable for an extended period.
13.2 We may move CHE PRO, or any part of it, to a different platform or provider. Where reasonably possible we will give you at least 14 days’ notice by email. You may need to set up a new login, and your use of a new platform may be subject to that provider’s terms of use. Your Membership, Membership Term and locked price will continue unchanged. We will take reasonable steps to transfer your progress and CPD Certificate records, but recommend you download your CPD Certificates when we tell you about a move.
13.3 We may suspend access to CHE PRO for planned maintenance, security or legal reasons, and will try to give notice of planned maintenance.
14.1 You may end your Membership by cancelling within a Cancellation Period (clause 6.1), by stopping renewal (clause 7.3), or under clause 6.5 or clause 14.4.
14.2 We may suspend or end your Membership immediately by notice if you:
No refund is due if we end your Membership under this clause 14.2, and any Monthly Plan instalments that fell due before it ended remain payable.
14.3 We may close CHE PRO, or end your Membership for any other reason, by giving you at least 30 days’ notice. We will then refund the fees you have paid for the unexpired part of your Membership Term.
14.4 If we change these Terms under clause 18 in a way that is materially to your disadvantage, you may end your Membership by notice before the change takes effect, and we will refund the fees you have paid for the unexpired part of your Membership Term.
14.5 When your Membership ends, your access to the Platform, Community and Content ends and the licence in clause 10.2 ends. Clauses 10, 11, 12.4, 15, 16, 17 and 20 continue to apply.
15.1 CHE PRO is professional education for practising homeopaths. It is not medical, clinical, legal or business advice, and it does not replace your own professional judgment or any supervision your professional body requires.
15.2 You are solely responsible for your clinical decisions, the care of your patients, and complying with the laws, regulations, advertising rules and professional standards that apply to your practice in each country where you practise.
15.3 We do not guarantee any particular outcome from CHE PRO, including clinical or business results, or the acceptance of CPD hours by any professional or registering body.
15.4 We strongly recommend that practising homeopaths seeing patients hold professional indemnity insurance appropriate to their practice in each country where they practise. Insuring your practice is your own responsibility; we do not require or check proof of insurance.
16.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
16.2 Subject to clause 16.1, we are not liable for:
16.3 Subject to clause 16.1, our total liability to you arising out of or in connection with your Membership, whether in contract, tort (including negligence) or otherwise, is limited to the fees you have paid for the unexpired part of your current Membership Term. We have no liability in respect of fees paid for periods of access already provided.
16.4 We are not responsible for any delay or failure caused by events outside our reasonable control, including failures of third-party platforms, internet or power outages, cyber-attacks, industrial action, pandemics or government action.
17.1 You will reimburse CHE for any claims, losses, fines and reasonable costs (including legal fees) that CHE suffers as a result of:
18.1 We may update these Terms from time to time, for example to reflect changes in the law, our services, the Platform or our payment arrangements. We will email you at least 30 days before any change takes effect, unless a change is needed sooner for legal or security reasons, in which case we will give as much notice as we reasonably can.
18.2 If your Membership continues after a change takes effect, the updated Terms apply. Clause 14.4 applies to changes that are materially to your disadvantage. A change to these Terms will not increase your locked price under clause 5.4.
19.1 Our Privacy Policy explains how we use your personal information, including in recordings, the Community, cookies and marketing. You are responsible for Patient Information you share under clause 11.
20.1 Complaints. If you are unhappy with CHE PRO, please email [email protected]. We will acknowledge your complaint promptly and try to resolve it fairly.
20.2 Notices. We will send notices to the email address on your account, which you must keep up to date.
20.3 Transfer. We may transfer our rights and obligations under these Terms to another company in the Centre for Homeopathic Education group or to a buyer of the CHE PRO business. You may not transfer your Membership or your rights under these Terms.
20.4 Entire agreement. These Terms, including Schedule 1, and the plan details shown at checkout, form the whole agreement between you and us about your Membership.
20.5 Severance. If a court decides that any part of these Terms is invalid or unenforceable, the rest of these Terms will continue to apply.
20.6 No waiver. If we delay in enforcing these Terms, we can still enforce them later.
20.7 Third-party rights. No one other than you and CHE has any right to enforce these Terms, except that CHE group companies may rely on clause 12.4.
20.8 Governing law and jurisdiction. These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
CHE PRO is a professional community. This Code of Conduct applies in the Community, in Live Sessions (including chat), in direct messages between Members and in any other CHE PRO space.
CHE moderators may remove content at any time. Depending on how serious a breach is, we may give a warning, restrict or suspend your access to the Community or Live Sessions, or end your Membership without refund under clause 14.2. We will usually give a warning first but may act immediately for serious breaches.
